Pharmaceutical Liability

The Biodefense and Pandemic Vaccine and Drug Development Act of 2005 will strip you of your Seventh Ammendment right to take negligent drug companies to court in front of a jury of your peers.

And this is a Good Thing. Biodefense and influenza countermeasures are simply a risky business. If Big Pharm is going to make billions, they should bear the risk, not pass it on to me.

Instead of fostering corporate responsibility, the law establishes BARDA, a new R&D agency, to shroud corporations in secrecy, exempting the program from the Freedom of Information Act and the Federal Advisory Committee Act, which require transparency.
